On 28 July 2018, the Economic Freedom Fighters held their fifth anniversary celebration at Sisa Dukashe Stadium in Mdantsane, Eastern Cape. In front of approximately 20,000 supporters, EFF leader Julius Malema was filmed firing what appeared to be a semi-automatic rifle. The viral video prompted AfriForum to lay criminal charges in August 2018.

The matter proceeded through the East London Magistrate's Court. On 1 October 2025, Magistrate Twanet Olivier found Malema guilty on all five counts: (1) unlawful possession of a firearm, (2) unlawful possession of ammunition, (3) discharge of a firearm in a built-up area, (4) failure to take reasonable precautions for the safety of persons or property, and (5) reckless endangerment of person or property.

Pre-sentencing arguments were heard on 15 and 16 April 2026. State prosecutor Joel Cesar argued that Malema's actions posed an extreme danger to the public and warranted the maximum penalty of 15 years' imprisonment. The defence argued for a non-custodial sentence, citing Malema's status as a first-time offender and his parliamentary and family responsibilities.

If sentenced to more than 12 months' imprisonment without the option of a fine, Malema stands to lose his seat in Parliament under Section 47(1)(e) of the Constitution and be disqualified from holding public office for five years. This would have significant political consequences for the EFF, which he has led since its founding in 2013.
